At the Regular Meeting of the Board of Supervisors of Frederick County,
Virginia, held in the Supervisors Room, on the 8th day of July, 1963.
PRESENT: B. 0. Brumback, Chairman; Paul Luttrell, W. Hurl Himelright; C. E.
Garber and Grover Teets.
The minutes of the last meeting held on the 10th day of June, 1963 were
read and approved.
REPORTS: Upon motion duly made and seconded the reports of Harry L. McCann,
' Treasurer; Earl S. Bailey, Commissioner of Revenue; Robert L. DeHaven, Sheriff of the County
of Frederick; Joseph A. Massie, Jr., Commonwealth Attorney; Robert&A. James, Department of
Welf are; Agnes Shirley, Home Demonstration Agent; John Wolfe, County Agent and D. H. Gauldin,
Road Engineer were read and approved.
RECORDING MACHINE - DR. DOERWALDT
Upon motion of Grover Teets and seconded by Paul Luttrell it is ordered that
Dr. Doerwaldt's record of the meeting and the the recording machine be removed from the
Supervisors Room.
VACCINATION OF DOGS FOR RABIES '
A number of Delegations and Individuals appeared before the Board and
a number of Petitions for and against the adoption of an ordinance for Compulsory Vaccination
of Dogs against Rabies. A general discussion was had for and against the said Ordinance.
Upon motion of Paul Luttrell and seconded by W. Hurl Himelright, BE IT
RESOLVED that action on Ordinance be tabled. Voting for the Resolution were Paul Luttrell,
W. Hurl Himelright and Charles E. Garber. Both Grover Teets and B. 0. Brumback abstained
from voting.
WHITACRE SUBDIVISION - SECTION A
Upon motion duly made and seconded the following Resolution was adopted;
BE IT RESOLVED: That Scott Street, Whittier Avenue, and George Street in

ENACTMENT OF AMENDED SUBDIVISION ORDINANCE
The enactment of amended Subdivision Ordinance in regard to issuance of
subdivision building permits the enactment having been postponed from June meeting to the
July meeting was postponed to the August 1963 meeting.
HEALTH UNIT
Upon motion the Clerk is ordered to notify Dr. Fears to be present at the
August Meeting in regard to the issuance of building permits.

HOSPITAL CONTRACT - WINCHESTER MEMORIAL HOSPITAL
Upon motion, duly made and seconded, the Board approved and entered
into a contract for the Hospitalization of Indigent persons with the Winchester Memorial
Hospital for the term beginning on the 1st day of July 1963 and expiring on June 30, 1964,
at the rate of $23.97 per day.
HOSPITAL 'CONTRACT - MEDICAL COLLEGE OF VIRGINIA
Upon motion, duly made and seconded, the Board approved and entered
into a contract for the Hospitalization of Indigent persons with the Medical College of
Virginia for the term beginning on the 1st day of July, 1963 and expiring on the lst day of
July, 1964, at the rate of $27 per day.

HOSPITAL CONTRACT - UNIVERSITY CF VIRGINIA
Upon motion, duly made and seconded, the Board approved and entered
into a contract for the Hospitalization of Indigent persons with the University of Virginia
for the term beginning on the 1st day of July 1963 and expiring on the 30th day of September,

1964, at the rate of $26.29 through September 30, 1963 and thereafter the rate will be the
SIH ceiling as established by the State Board Welfare Institution ($28 per day.
ROADS - APPROVES THE 1963 -1964 SECONDARY ROAD BUDGET
Upon motion duly made and seconded the following resolution was
passed.
At a regular meeting of the Board of Supervisors of Frederick
held at Winchester, Virginia, on Monday, August 12, 1963 the following resolution was
adopted:

BE IT RESOLVED, that this Board hereby approves the 1963 -1964
Tentative Secondary Maintenance and Construction Budget for Frederick County, as submitted
by D. H. Gauldin, Jr., Resident Engineer.
This approval is given with the understanding that this budget is
subject to review and possible changes by the State Secondary Roads Engineer.
' DICKS HOLLOW ROAD
A Delegation appeared before the Board requesting that the Dicks
Hollow Road be improved. Some petitions were filed. They were advised to confer with Mr.
' D. H. Gauldin, Resident Engineer.
MACEDONICA ROAD
A Delegation appeared before the Board and requested that the
Macedonia Road, East of Stephens City, Va., be hard surfaced.
The Delegation was advised to confer with Mr. D. H. Gauldin, Residen+
Engineer.
SMITHS RENDERING PLANT - NEAR ROUND HILL
A Delegation of Citizens of Bethel Church with Jim Sirbaugh as their
Chairman requesting the Board to take action on an odor problem allegedly caused by said
Rendering Plant.
DELINQUENT TAXES
The County Treasurer, Harry L. McCann presented to the Board a list
of Peronal Property Tax for the year July 1, 1962 to June 30, 1963 in the amount of $15,707.
and also the Delinquent Real Estate Tax for July 1, 1962 to June 30, 1963 in the amount of
$19,298.29. The total being $35,006.82.
TRAPPING FOXES
The Board having been requested to discontinued the payment of
Bounty on Foxes until the end of the State Cooperative Predator Rabies Control Program.
Due to the fact that this program will be finished within a few days
and upon motion duly made and seconded the request to discontinue the payments was not
granted.
The vote was as follows: Paul Luttrell, W. Hurl Himelright and
C. E. Garber against and Grover Teets voted for.
AMENDMENT TO ORDINANCE REQUIRING A BUILDING PERMIT
The amended Ordinance on Building Permits having passed its first,
second and third reading and having been advertised for a public hearing which said hearing
was had and the enactment of said Ordinance was postponed until the August Meeting and upon
' motion duly made and seconded said Ordinance was enacted..
Paul Luttrell voted against the enactment. W. Hurl Himelright, C. E.
Garber and Grover Teets voting for the enactment.
The Ordinance shall become effective as soon after passage thereof as
provided by law.
The Clerk is ordered to have a copy published in the Winchester

PETITION FOR VARIANCE
The undersigned, Cloverdale Farms, Incorporated, by counsel,
respectfully petitions the Board of Supervisors of Frederick County, Virginia and the Frederick
County Planning Commission for a variance for existing zoning regulations for the purpose of
erecting on the land of the petitioning corporation bounded on the North and East by proposed

Upon motion duly made and seconded the following resolution was pas
BE IT RESOLVED that the Board of Supervisors purchase, if possible,
the real estate of Philip Williams, Elonzy W. Smith, Alex Craig and Roy McKee which adjoins
the Frederick County Dump property and right of way for additional County Dump area.
BE IT FURTHER RESOLVED that before making an offer for the properties
that the Clerk of the Board engage two Real Estate Brokers as appraisers to ascertain the
value of the properties before making an offer for the same.
APPRAISERS - BRYAN STOTLER - HOY RIIEY - LAND PHILIP WILLIAMS ET ALS
At the Regular Meeting of the Board of Supervisors of Frederick
on the 12th day of August, 1963. The Clerk of the Board was ordered to appoint two appraise
to appraise the land of Philip Williams, Elonzy Wilson Smith, Alex Craig and Roy McKee, for
the purpose of filing condemnation proceedings of the said Real Estate to be used for a
County Dump. Now wherefore I, Lee N. Whitacre, Clerk, do hereby appoint Bryan Stotler and
Hoy Riley.
JANITOR'S SALARY - WILBUR P. ANDERSON
Upon motion duly made and seconded, it is ordered that the salary
of Wilbur P.Anderson be, and hereby is fixed at $3,600.00 for the year beginning on the 1st
day of July, 1963.

The following is a report of the Frederick County Planning Commission
as follows:
The report of the Frederick County Planning Commission on a petition
for a variance filed by Cloverdale Farms, Incorporated, August 12, 1963, and amended report
filed September 3 1963, on behalf of Cloverdale Farms, Incorporated, and Humble 011 and
Refining Company.
The Frederick County Planning Commission, after due advertisement in
the Winchester Evening Star, met at 10:00 A. M. in the Board Room of the Board of Supervisors
in the County Office Building in the City of Winchester, Virginia, and considered the petitio.

Only one interested resident of Frederick County appeared and made no
objection to the petitions.
After due consideration and on motion duly made and seconded the
Frederick County Planning Commission duly approved the granting of the petitions and makes

SCHOOL BOARD - PETITION FOR TRANSFER OF SCHOOL FUNDS

The Frederick County School Board hereby petitions the Frederick
County Board of Supervisors to instruct the Treasurer of Frederick County to transfer
$6,000.00 from the Frederick County School Board Textbook Fund to the Capital Outlay item

On Motion Duly Made and Seconded, Be It Resolved That:
No certificate from the Frederick County Health Department shall be
required for excavation construction, erection of any building, wall or structure or any part
thereof or demolition thereby any person, firm or corporation when no sewer or water or bath
is required for said building, or the present water or sewer system is not affected by
enlargement of the structure.

WHEREAS, Secondary Route 608 from 1.50 miles south of Route 50 to 1.60 miles
south of Route 50, has been altered, and a new road has been constructed and approved by the
State Highway Commissioner, which new road serves the same citizens as the road so altered
and,
WHEREAS, this new road follows a new location, this being shown on the att
sketch titled, Sketch Showing Section of Road to be Abandoned and Section to be Added to
be Added due to Relocation of sharp curve, Route 608, Frederick County, Budget Item 3001,
1961 -62 Budget,
NOW THEREFORE BE IT RESOLVED: That the Old location of Route 608, i.e., Sect
1, shown in blue on the aforementioned sketch, a total distance of 0.11 mile, be and the same

BE IT RESOLVED that the Board of Supervisors commence Eminent Domain
Proceedings against Elonzy'W. Smith, Alex Craige and Roy L. McKee for:their land adjoining
the County Dump and that Joseph A. Massie, Jr., Attorney -at -Law be authorized to commence the
necessary court action on behalf of the County and prosecute the same to a conclusion and do
all things necessary in conducting the same. BE IT FURTHER RESOLVED that should the said own

BE IT RESOLVED: That the Highway Department is hereby requested to add the
following section of road to the Secondary System of Frederick County:
A section of private road leading off of Route 659 at 0.20 mile south west
of Route 7, extending in an easterly direction for a distance of 0.45 mile. Length - 0.45
A forty foot (40') unrestricted right of way is guaranteed, this right of way
is recorded in the Clerks Office of Frederick County in Deed Book 292, Page 675, dated
16; 1963•
Upon motion duly made and seconded the following Preamble and
Resolution was unanimously adopted.
WHEREAS, Cloverdale Farms, Inc. and Humble 011 and Refining
hereinafter called Petitioners, have heretofore filed a petition and amended petition re-
questing amendment of the existing zoning ordinance to permit the construction and operation
of a motor hotel, restaurant and automobile service station on land owned by Petitioners
situate in Stonewall Magisterial District and more particularly described hereafter; and
WHEREAS, the matter was thereafter in due course referred to the
Planning Commission which has reported its approval of the amendment to the Board as being

in keeping with good zoning practice; and

WHEREAS, the Board thereupon the 16th day of September, 1963 directed
a public hearing be held thereon in accordance with §15- 968.7, Code of Virginia, as amended,
and that notice thereof be published as required by law; and
WHEREAS, pursuant to the aforesaid notice a public hearing was held in
the manner prescribed by law on the 14th day of October, 1963, at 11:00 A. M. at the Board

and being situate in Stonewall Magisterial District, Frederick County, Virginia, containing
20 Acres, more or less, said land being bounded on the South and East by proposed Interstate
Route No. 81, on the North by the Pennsylvania Railroad right of way and on the West by Virgi a
Secondary Route No. 661 (the Welltown Pike).
FREDERICK COUNTY DUMP - PURCHASE LAND FROM PHIL WILLIAMS
Upon motion duly made and seconded it was unanimously decided that the
Board accepts the offer of Phil Williams in the sum of Two Thousand and Three Hundred Dollars
($2,300.00) which is located in Shawnee District adjoining the present County Dump, and being
the same land as described in the Current Minute Book on Page 8, that a deed be drawn by the

An Ordinance for the purpose of adopting Article 2, Sections 15 -794.3
Title 15 of the Code of Virginia for 1950 and as amended, providing certain local requirement

A copy of the above Ordinance on Subdivisions was presented to the

1. It is desired to contract with the Board of Trustees of the
Virginia Supplemental Retirement System to borrow from said System a second loan in the am
of $700,000.00 and issue bonds in the name of Frederick County in that amount to represent
such borrowing for the purpose of constructing the Frederick County Junior High School in
Frederick County, pursuant to Chapter 19.2 of Title 15 of the Code of Virginia. A first loan
of $600,000.00 has been approved, making the total loan $1,300,000.00.

Board of Supervisors of Frederick County for its approval.

The following ordinance for Frederick County to impose a county
recordation tax on each taxable instrument passed its first and second reading. j
Be It Resolved that the Board of Supervisors on First and Second
Reading by Title adopt an ordinance providing for a tax of 5 cents a hundred being one third
of the amount of the State recordation tax collectible for the state on the first recordation
of each taxable instrument in said County to be paid into the General Fund of the County to
be collected by the Clerk of the Circuit Court.
A Public Hearing will be held January 13, 1964 for the third and
final reading and enactment.
Voting for the Resolution were Grover Teets, Bryon Brumback and
W. Hurl Himelright.
Not Voting were Paul Luttrell and Charles E. Garber.

Mrs. Elizabeth L. Sheetz, Clerk of the Frederick County School
Board, appeared before the Board and stated for the School Board that the State Board of
Education requires permanent Literary Loan Bonds to be executed in equal amounts. The
approved application for a Literary Loan on the recently completed James Wood High School

called for the loan to be repaid in ten years. The Board on motion of Grover Teets
(land seconded by Paul Luttrell approved a retirement schedule, with the first bond of
,750.00 coming due on December 15, 1964, and a bond of equal amount each year thereafter,
the.total loan of $117,500.00 has been repaid.
' FREDERICK COUNTY JUNIOR HIGH SCHOOL
The following Resolution was adopted by the Frederick County School Board:
The Frederick County School Board in special session on December 6, 1963,
unanimously adopted the following resolution on motion of Mr. Clyde Logan and seconded by Mr.
Huyett G. Light:
' Be it resolved that the School Board of Frederick County agrees to pay up
to one -half of the cost of building a 24 paved 60' street on the land dedicated by J. Kenneth
Robinson from the intersection of Linden Avenue, Extended, aid the Frederick County Junior
High School lot eastwardly and northwardly to the southern end of the unloading circle to the
front of the school, not to exceed the contract cost of building the proposed 30' street on
the said school lot from Linden Avenue, Extended, to the southern end of the said parking lot.
Provided further that the said J. Kenneth Robinson will dedicate a 60'
ide street or roadway from the intersection of Linden Avenue, Extended, and the said school
adjoining the said school lot eastwardly and northwardly to the intersection of the north-
corner of said school lot and the extension of Caroline Street.
Provided further that J. Kenneth Robinson will pay the remaining costs of
onstructing the street from Linden Avenue, Extended, to the southern end of the unloading
circle.
I FRIDERICK COUNTY JUNIOR HIGH SCHOOL
On motion duly made and seconded the following Resolution was passed:
WHEREAS, the Frederick County School Board desires to change the location
of its access roadway from Linden Avenue Extended across its Junior High School Lot purchased
from J. Kenneth Robinson to a new roadway on the land of J. Kenneth Robinson adjoining the
southern and eastern boundary of said lot to Caroline Street extended; and,
WHEREAS, J. Kenneth Robinson desires to dedicate a 60' right of way from
Linden Avenue extended at its intersection with the Southern boundary of said school lot
along the southern and eastern boundary of said school lot to Caroline Street extended at the
Northeastern corner of said lot and is willing to pay J of the cost of said street from Linden

NOW THEREFORE be it resolved that the Board of Supervisors of Frederick
County does hereby authorize the Frederick County School board to change the road plans on its

RECORDATION TAX
The Board of Supervisors of Frederick County, Virginia, at its
regular meeting held at the Frederick County Court House in Winchester, Virginia, on December)
9.`1963 directed the advertisement in the manner prescribed by law of the following ordinance
which will be proposed for passage by the said Board of Supervisors at its next regular meet -I
ing to be held at the Frederick County Court House on January 13, 1964, at 11:00 A. M., to -wi
BE IT ORDAINED by the Board of Supervisors of Frederick County,
Virginia, that the following ordinance be passed and ordained:
THAT THE BOARD OF SUPERVISORS OF Frederick County, doth impose a
county recordation tax in an amount equal to one -third of the amount of the State recordationi
tax collectible for the State on the first recordation of each taxable instrument as provided
for in Section 58 -54 of the Code of Virginia for 1950, as amended; provided,,no tax shall
be imposed under.this ordinance upon any instrument in which the State recordation tax is
fifty cents specifically; and provided further, that where a deed or other instrument conveys
covers or relates to property located partly in Frederick County and partly in another county
or city, or in other counties or cities, the tax imposed under the authority of this
shall be computed only with respect to the property located in Frederick County.
The Clerk of the Circuit Court of Frederick County collecting the
tax imposed under this ordinance shall pay the same into the treasury of Frederick County.
For his services in collecting the tax imposed by this ordinance, the Clerk shall be compensa
out of the treasury of Frederick County in the amount of five per cent upon each instrument
taxable under this ordinance recorded in his office. Such compensation shall be paid out of
the county treasury.
The effective date of this ordinance shall be the first moment.of
February 1, 1964.
The Clerk of this Board is directed to publish in the manner
prescribed by law, the above proposed ordinance.

SCHOOL;BOARD PLANS FOR AN ELEMENTARY SCHOOL LOCATED ON SENSENY ROAD
The Board on motion of Donald L. Baughman and seconded by Grover
Teets gave unanimous approval to a request by the Frederick County School Board that it be
permitted to employ the services of an architect to draw up preliminary plans for a proposed
elementary school to be constructed on land now owned by the School Board and located on the
Senseny Road east of Winchester, Virginia.

part time state assessor.
